Former party leader Irungu Nyakera has urged the government to immediately reinstate Deputy President Rigathi Gachagua’s security detail, staff, and privileges following a Court of Appeal ruling that declared the bench which handled Gachagua’s impeachment as “unlawfully constituted.”
In a statement issued Monday, Nyakera emphasized that the appellate court found Deputy Chief Justice Philomena Mwilu’s appointment of the three-judge panel on October 18, 2024, unconstitutional, and directed that the petition be reheard by a lawfully empaneled bench.
“Until a valid bench is constituted, the stay order issued by the Kerugoya High Court remains in effect,” Nyakera stated. “This means Rigathi Gachagua lawfully remains the Deputy President of Kenya, and all his official privileges must be reinstated without further delay.”
Nyakera also warned that continued recognition of Kithure Kindiki as Deputy President defies the Constitution and an active court order.
“Such a move flies in the face of our supreme law and undermines the integrity of the judicial process,” he said.
He called on the Office of the President and the Judicial Service Commission to expedite the formation of a constitutionally valid bench to hear Gachagua’s case and uphold due process.
